Priya Kapur has filed a Rs 20 crore defamation suit in the Delhi High Court against her sister-in-law Mandhira Kapur Smith over alleged defamatory statements she made against her.

Priya Kapur, wife of late industrialist Sunjay Kapur, has approached the Delhi High Court with a civil defamation suit against her sister-in-law, Mandhira Kapur Smith, seeking damages of Rs 20 crore and an injunction restraining further allegedly defamatory statements.
According to a report by Bar and Bench, the suit has been filed over statements made by Mandhira Kapur Smith on social media platforms and in a podcast titled ‘InControversial with Pooja Chaudhri’.
The podcast host, Pooja Chaudhuri, has also been arrayed as a defendant in the case.
ALLEGATIONS OF A ‘SYSTEMATIC’ CAMPAIGN
Bar and Bench reported that Priya Kapur has alleged that within days of Sunjay Kapur’s demise, Mandhira Kapur Smith “embarked upon a systematic and organised course of conduct aimed at maligning, humiliating and socially discrediting her".
In her plea, Kapur contended that Smith repeatedly uploaded and circulated videos and posts on social media identifying her and making false allegations and insinuations designed to provoke “hatred, ridicule and social ostracism."
As per the suit, the allegedly defamatory statements “falsely impute dishonesty, moral impropriety, professional incompetence, concealment of assets and illegitimate assumption of corporate control to the plaintiff."
The plea further states that the content was deliberately published and amplified through the podcast platform.
Kapur has sought an injunction to restrain Smith from continuing to make or circulate such statements.
In addition, she has claimed Rs 20 crore in damages for “loss of reputation, mental agony, emotional distress and social humiliation" allegedly caused to her.
The suit has been filed through advocate Smriti Asmita.
Notably, the report mentioned that a criminal defamation complaint filed by Priya Kapur against Mandhira Kapur Smith is already pending before Delhi’s Patiala House Court over similar statements.
BROADER FAMILY DISPUTE OVER TRUST
The defamation proceedings are unfolding amid an ongoing legal battle within the Kapur family over control of assets and a family trust.
As reported by news agency PTI, the Delhi High Court recently sought the stand of Rani Kapur, the mother of the late Sunjay Kapur, on an application filed by Priya Kapur seeking initiation of perjury proceedings under the Bharatiya Nagarik Suraksha Sanhita.
Justice Mini Pushkarna issued notice to Rani Kapur and asked her to file her reply.
Priya Kapur’s application alleged that there were “unimpeachable documents", including affidavits and photographs, to show that Rani Kapur made a “deliberate and false statement on oath" claiming she had neither signed nor read the RK Family Trust Deed.
The report mentioned that the High Court also issued notice to Rani Kapur on Priya Kapur’s plea seeking dismissal of her lawsuit for allegedly concealing and suppressing material facts.
The application claimed there had been a “gross abuse of process" amounting to fraud upon the court.
In her suit, Rani Kapur has sought a declaration that the RK Family Trust, constituted in her name in October 2017, be declared “null and void", alleging that it was based on “forged, fabricated and fraudulent" documents and that she had been wrongfully divested of her rights and assets.
Sunjay Kapur passed away on June 12 after collapsing during a polo match in England, reportedly due to a sudden cardiac arrest.
The High Court has urged family members to resolve their disputes amicably, and the matter is listed for hearing next in March.
