In an unusual verdict, the Supreme Court recently ordered a man to live separately from his mother and father in order to repair his relationship with his estranged wife and nine-year-old daughter. Holding his parents responsible for the “interference" in his marriage, the top court noted that the man was “in complete control" of his parents.

According to a Hindustan Times report, a bench of Justice JB Pardiwala and Justice KV Viswanathan said in their order last week that the husband is “completely under his parents’ control" and is not able to make any independent decisions, leading to his wife and daughter feeling neglected.

Citing parental interference as the root cause of their marital problems, the court ordered that the husband, wife, and their daughter will now start living separately on the first floor of the house. The court also made it clear that the husband cannot refuse to obey the order.

This case is related to an appeal against an order from the Chhattisgarh High Court last year. The wife had asked for maintenance and also accused the husband and his family of harassment, mistreatment, and assault, leading to separate cases.

The judges reportedly spoke to the husband, wife, husband’s mother, wife’s parents, and their nine-year-old daughter in the Supreme Court’s committee room. The court called the girl, who is in Class 4, a “smart child".

Focusing on reconciliation, the court said the arrangement of living separately should continue for at least three months, adding that if the wife’s parents want to visit their granddaughter, they are allowed to do so. The court said it hoped that all family members would treat each other with respect.

Even though they will live separately, the court said it expects the wife to help her in-laws if they fall sick or need daily help. Since the wife is currently pregnant with the couple’s second child, the court clearly told the husband to make sure his wife gets full medical care during her pregnancy, to take her regularly to the gynaecologist, and to make sure she does not face any trouble from her in-laws during this time.

The court also ordered that all ongoing civil and criminal cases between the husband and wife will be paused until the next hearing. The wife’s parents and brothers were also told not to create any problems in the couple’s married life.

The next hearing in this case will be on April 8, 2026. The court has told all parties to appear in person, but the wife is excused from appearing because of her pregnancy.

The court also made it clear that the order is not meant to fuel any legal conflict, but to focus on the well-being of the couple and their children.
