A daycare employee at a fitness club in Southern California allegedly threw a 23-month-old child in the air and failed to catch him, causing him a traumatic brain injury. The daycare facility at the Bay Club is now being sued by the toddler’s parents.

Matthew and Elena Kittle filed a complaint on July 2 against the club, alleging that their son –– identified by the initials C.K. –– was present at the daycare centre on March 17, 2025. An employee leapt him in the air, six feet above the ground, and failed to catch him. As a result, C.K. struck the ground and hit his head on the floor. The employee also lost her balance and fell on the child, according to the NBC News. 

The complaint alleged that The Bay Club downplayed the severity of the fall. C.K. had sustained a concussion and continues to experience side effects caused by the injury.

The club has been sued on the charges of negligence; negligence per se; negligent hiring, retention and supervision; negligent infliction of emotional distress; fraud — intentional concealment and intentional infliction of emotional distress, the NBC News reported.

CCTV Footage Comes To Light

CCTV footage of the incident has also surfaced, capturing the moment the incident unfolded. Shared on ‘X’, the video begins with the child –– dressed in a green t-shirt and black trousers ––running to the caretaker. She took his hands and started swinging him through her legs. Meanwhile, she threw the boy over her head into the air. As she tried to catch him, he crashed down onto the floor as other watched in awe.

Within nanoseconds, the workers also lost her balance and landed on the toddler.

The Bay Club has said in a statement that it is unable to comment on the ongoing litigation. “At the Bay Club, the safety of our members, team members, and the families we serve is our highest priority," it said.
