The Gauhati High Court has denied anticipatory bail to Congress leader Pawan Khera in a case linked to his allegations against Assam Chief Minister Himanta Biswa Sarma’s wife, raising the possibility of arrest as the court flagged the need for custodial interrogation.

CNN-News18 has accessed the High Court order, which held that there is a prima facie case of possession of forged documents against Khera and not merely a case of defamation as argued by the defence.

‘Custodial Interrogation Imperative’

The court observed that Khera was avoiding police investigation and said custodial interrogation was necessary to uncover the source of the documents he relied on.

It noted that such interrogation was “imperative" to identify associates who may have collected or provided the documents to him.

Court Rejects Political Defence

The High Court also rejected the argument that the case was political in nature. The court observed that the Assam Chief Minister’s wife is not an active political figure and said the matter could have been viewed differently had the allegations been made directly against the CM.

The court further remarked that an “innocent lady" had been dragged into controversy for political mileage.

No Evidence To Back Claims

The order stated that Khera has not been able to establish his claims, including the allegation that Riniki Bhuyan Sharma holds passports of multiple countries.

It also said there was no material to suggest that the case had been filed to harass or humiliate Khera.

Case Background

Khera had approached the Gauhati High Court after the Supreme Court stayed a transit anticipatory bail granted to him by the Telangana High Court and asked him to seek relief in Assam.

The case stems from allegations made by Khera regarding multiple passports and overseas assets, following which Sharma filed criminal complaints under various provisions of the Bharatiya Nyaya Sanhita.

With the High Court rejecting anticipatory bail, the case is now expected to move into the next stage of investigation.
