Gujarat HC Grants Parole To Couple Serving Life Term In Murder Case For IVF Treatment

In an unusual and emotionally charged case, the Gujarat High Court has granted temporary parole to a couple serving life imprisonment to undergo in-vitro fertilisation (IVF) treatment, allowing them a chance to become parents despite being behind bars.

The convicts, Jayendra Damor and his wife, Sejal Bariya, have been in prison for over 15 years for the murder of Sejal’s ex-boyfriend, Pinakin Patel, in 2010. The couple, now aged between 38 and 40, approached the Gujarat High Court seeking permission to pursue IVF, citing age-related fertility concerns and their desire to have a child.

In 2023, the High Court had granted parole to Sejal to begin infertility treatment under a specialist in Dahod. Following her medical assessment, Jayendra too sought similar relief to participate in the ongoing IVF process. The court, recognising the humanitarian aspect of their plea, temporarily released him on October 16 to facilitate the procedure.

However, as the medical process could not be completed within the stipulated period, both convicts appeared before the court once again on October 28. Hearing the plea, Justice HD Suthar extended their parole until November 2, directing that they must return to prison immediately thereafter.

The case dates back to 2010, when Sejal’s former partner, Pinakin Patel, allegedly began harassing her after their breakup. Enraged and humiliated, Sejal and Jayendra conspired to eliminate him. Patel was found murdered at a guesthouse in Pavabadh, near Godhra. Three years later, in 2013, a sessions court convicted the couple and sentenced them to life imprisonment.
