Porvorim: Speaker Ganesh Gaonkar on Tuesday said matters that are sub judice and pending consideration before courts of law, are not open for discussion on the floor of the House.“Details pertaining to victims of offences under the Pocso Act, the Goa Children’s Act, and similar laws cannot be sought or disclosed. These enactments expressly safeguard the identity and privacy of victims, and this House is duty-bound to uphold such protection,” Gaonkar said. He said personal finances, relationships, and private life of any individual fall within the ambit of the right to privacy, which is guaranteed and protected by law.
“No person or authority is entitled to infringe upon this right, except in accordance with the law,” he said.He added that members are also expected to exercise restraint in their remarks and to refrain from making statements that are defamatory or that undermine the dignity and reputation of any person.“Whenever information is sought, members are required to clearly indicate the specific provision of the Rules of Procedure and Conduct of Business of the legislative assembly under which such information is being sought,” the speaker said.
In response, St Andre MLA Viresh Borkar said a lot of matters are in court, and the reason people go to court is because govt does not listen to them. Borkar said govt will not answer questions stating that the matter is sub judice. “I would like you to give a ruling on my point of order,” Borkar told the speaker and insisted that the opposition get an opportunity to raise the issue.
