Delhi Riots Case: Court Denies Bail To Former MLA Tahir Hussain, Two Others

A Delhi court on Thursday denied bail to Salim Malik, Athar Khan, and former AAP councillor Tahir Hussain in connection with the 2020 northeast Delhi riots case.

Additional Sessions Judge Sameer Bajpai heard their bail applications and denied them bail.

These three are charged under the Unlawful Activities Prevention Act (UAPA) for their alleged roles in the 2020 riots.

The three had sought bail after the Supreme Court granted relief to five other accused in the same case, arguing that they faced similar charges and were entitled to equal treatment.

Athar, a former call centre employee, is accused of being one of the key organisers of the protest at Chand Bagh in northeast Delhi and of delivering inflammatory speeches.

According to the Delhi Police’s Special Cell, Athar allegedly attended secret meetings where he said, ‘the time has come to burn Delhi’ and helped coordinate the destruction of CCTV cameras.

Salim was also among the 11 alleged organisers and speakers at the anti-CAA/NRC meeting. The alleged organisers included Mohammed Saleem Khan, Salim Malik, Mohammed Jalaluddin alias Guddu Bhai, Shahnawaz, Furkan, Mohammed Ayub, Mohammed Yunus, Tabassum, Mohammed Ayaz and his brother Khalid.

The Supreme Court, on January 5, granted bail to five accused, Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman, Mohd Saleem Khan, and Shadab Ahmad in the 2020 Delhi riots conspiracy case.

However, the top court denied bail to activists Umar Khalid and Sharjeel Imam, observing that not all accused in the case stood on the same footing.

The bench of Justices Aravind Kumar and N V Anjaria said there was a prima facie case against Khalid and Imam under the UAPA while denying them bail.

Of the 20 accused named in the case, two are still absconding, while the remaining 18 have earlier applied for bail. Of these, seven continue to remain in jail, including Khalid, Imam, Athar Khan, Salim Malik, former AAP councillor Tahir Hussain, Tasleem Ahmed, and Khalid Saifi.
