Medical negligence cases: HC appoints amicus curiae

The Kerala High Court has appointed Akash S. as the amicus curiae to assist the court in formulating guidelines for the functioning of expert committees constituted to consider medical negligence cases.

The State informed the court that there are no guidelines on how the expert committee ought to function, since it was constituted based on the directions of the Supreme Court.

To this, the court said that the absence of guidelines would affect the right to fair trial of doctors involved in medical-negligence cases. The committee ought to consider the explanation of the doctor concerned before submitting the report and also serve a copy of the report on the doctor concerned, it added.
