Supreme Court To Hear Petitions Challenging Citizenship Amendment Act On May 5

The Citizenship Amendment Act 2019, which allows non-Muslim migrants from Pakistan, Bangladesh, and Afghanistan to get citizenship, has been challenged as unconstitutional.

The Supreme Court on Thursday announced that it will hear petitions challenging the Citizenship Amendment Act, 2019, from May 5, 2026. A bench comprising Chief Justice of India Surya Kant, Justice Joymalya Bagchi and Justice Vipul Pancholi was considering the petitions for procedural directions.

The Parliament passed the Citizenship Amendment Act in December 2019, which amended the earlier Citizenship Act of 2015. The law provided a fast-track pathway to Indian citizenship for religious minorities who escaped persecution in Pakistan, Bangladesh and Afghanistan. The matter was last listed in the apex court on March 19, 2024.

Senior Advocate Indira Jaising urged that the petitions concerning Assam and the other North-Eastern states be heard separately, as they involve issues related to Section 6A of the Citizenship Act and the interline permit.
