The Supreme Court is set to pronounce its decision on applications seeking a stay on the Waqf (Amendment) Act, 2025, on Monday (September 15). A bench of Chief Justice BR Gavai and Justice AG Masih had reserved the order on May 22.
The apex court had reserved its interim orders on three orders, including the power to denotify properties declared as “waqf by courts, waqf-by-user or waqf by deed", after hearing a clutch of pleas challenging the validity of the Waqf (Amendment) Act, 2025.
The Waqf (Amendment) Bill, 2024, was passed in the Budget Session 2025 – from January 31 to April 4 – after a 12-hour debate in both Houses of the Parliament. The bill was cleared by the Lok Sabha with the support of 288 members, while 232 MPs were against it. The Rajya Sabha saw 128 members voting in its favour and 95 against it.
The Act aims to modify the Waqf Act 1995 and to address the challenges in the regulation and oversight of waqf properties. Opposition alleged it was aimed at weakening Muslim institutions, while the government called it a transparency reform.
