Can WhatsApp chats be used as evidence in divorce cases?

NEW DELHI: In modern divorce disputes, WhatsApp conversations often become a major part of the courtroom battles. Messages, screenshots, voice notes, photos, call logs, and even deleted chats are increasingly being produced before courts to prove allegations such as cruelty, adultery, harassment, financial disputes, or threats.Are WhatsApp chats legally admissible?Yes. Electronic records, including WhatsApp messages, are recognised as evidence under Indian law. Under the Bharatiya Sakshya Adhiniyam, 2023 — electronic and digital records including WhatsApp chats are treated as primary evidence. Section 63 of the Act lays down the rules for admissibility of electronic evidence.Courts in India have repeatedly accepted electronic communication such as:

  • WhatsApp messages
  • Emails
  • SMS records
  • Audio recordings
  • Digital photographs
  • Social media conversations

A WhatsApp screenshot alone may not always be enough. To formally prove electronic records in court, parties need a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023, which confirms:

  • The electronic record was produced from a genuine device
  • The device was functioning properly
  • The copy presented is authentic
  • The data has not been tampered with

Notably, the law now requires two signatures on this certificate — one from the person in charge of the device and one from a digital forensics expert.How are WhatsApp chats used in divorce matters?WhatsApp chats are increasingly used as evidence in divorce and matrimonial cases. Courts have accepted them in cases involving cruelty, abusive or threatening messages, affairs, financial disputes, domestic violence, child custody battles, and even to show whether a couple was living together or trying to reconcile. Courts usually look at the full conversation rather than a single screenshot taken out of context.

For example, affectionate chats may weaken allegations of cruelty, while threatening or abusive messages may strengthen claims of harassment.Can deleted chats be recovered?Deleted WhatsApp chats can sometimes be recovered. Investigators can retrieve them from cloud backups, the phone itself, or linked devices. In some cases, service providers may also have records. If either side disputes the authenticity of a chat in court, the judge can order a forensic examination of the device.Are secretly recorded chats allowed?Indian courts have, in some situations, accepted secretly recorded conversations as evidence, particularly in matrimonial disputes. In a landmark ruling in July 2025, the Supreme Court in Vibhor Garg v. Neha held that secretly recorded phone calls between spouses are admissible as evidence in divorce proceedings. The Court ruled that such recordings are not barred by spousal privilege, particularly when the dispute is between the spouses themselves, and that the right to privacy, while fundamental, must be balanced against the right to a fair trial.Can screenshots alone prove a case?Not always. Screenshots can be challenged on grounds such as:

  • Editing or manipulation
  • Incomplete conversation history
  • Lack of authentication
  • Absence of metadata

That is why courts often prefer complete chat exports, device verification, or supporting evidence rather than standalone screenshots.What have courts said?Courts across India have increasingly relied on WhatsApp conversations in divorce and domestic violence cases to assess conduct of spouses, mental cruelty, intention behind actions, and communication patterns between parties.However, courts also caution that digital evidence must be carefully verified before being relied upon. In Supriya Gaurav Devare v. Gaurav Jitendra Patil (2026), the Bombay high court set aside a divorce decree that had been granted solely on the basis of WhatsApp chats, holding that mental cruelty cannot be established through selective messages taken out of context and that the other side must be given a fair opportunity to contest the evidence.WhatsApp chats can play a major role in divorce proceedings in India, but admissibility depends on authenticity and compliance with the certification requirements under the Bharatiya Sakshya Adhiniyam, 2023.
